Below is the text of the Burning Hill 2024 waiver. When you go through the ticketing and registration process, each adult attendee will be asked to sign a waiver for themself and any accompanying minors.

BURNING HILL 2024: WAIVER & RELEASE

This is an Agreement Regarding My Acceptance of Risks, Waivers, Releases and Indemnification of the 2024 Hosts + Contributors In consideration of being permitted by Burning Hill LLC ("Burning Hill") to participate in the August 2024 Burning Hill Festival (the “Festival”) and in recognition of the 2024 Contributor’s reliance hereon, I, the person whose e-signature appears below, agree to all the terms and conditions set forth in this instrument (this “Agreement”). The Festival is a private, voluntary, and all-volunteer event and participation is by invitation only. By virtue of my acceptance of my invitation, as evidenced by my ticket reservation(s), I hereby acknowledge and recognize and accept responsibility for all risks to me (and my minor dependent(s) at the Festival) that an outdoor event may have, including but not limited to such inherently risky activities as swimming (and attendant dangers such as drowning), camping, hiking through the woods and riding on motorized vehicles (and attendant dangers such as broken bones, death or other serious injuries), pyrotechnics, fire-dancing, sparklers and bonfires (and attendant dangers such as death or serious injury due to burning), and other outdoor activities that involve risks of injury, disability, death, and/or property damage. And that by my attendance I assume full legal, medical, financial and all other responsibility for myself, and, as the case may be, each of my minor dependents attending the Festival as listed in the space below (“Dependent(s)”). I understand that Burning Hill may terminate my access to or participation in the Festival immediately, without notice, for any conduct that Burning Hill, in its sole discretion, believes is in violation of any applicable law or is harmful to another participant, a third-party, a service provider, or Burning Hill. By attending the Festival, I am assuming these and other risks on behalf of myself and my Dependents (if applicable), and I agree that this Agreement is legally binding on me and my Dependents (as applicable).

1. I on behalf of myself and my Dependents (if any) (and on behalf of my executors, administrators, heirs, next of kin, successors, assign, and anyone claiming any interest in them) — hereby knowingly, intentionally and voluntarily assume all of the risks and liability arising from or by participation in the Festival, and hereby waive, release, indemnify and agree to hold harmless each and every one of the individuals and entities listed on this website as “2024 Contributors” (hereinafter, the “Released Parties”) from any and all actions, suits, claims, damages and liability (including, but not limited to, payment of any and all attorneys’ fees and costs), that I, my family, Dependents, heirs, successors, assigns and anyone claiming any interest through me may have for any injury, death, harm or property damage caused to me or by me or by others (including any Dependents or others acting on my behalf), arising out of my or any Dependent’s presence at or participation in the Festival. I covenant not to make or bring any such claim against the Released Parties or any other person, and forever release and discharge the Released Parties and all other persons from liability under such claims. I acknowledge and agree that the liability I am hereby assuming may arise from ordinary negligence or carelessness on the part of the Released Parties.

2. I personally assume all risks for myself and any Dependents, whether foreseen or unforeseen, in connection with my (or any of my Dependent’s) participation in the Festival, for any harm, injury, or damage that may befall me during my participation in the Festival, including the risk of negligence on the part of the Released Parties or any other party or participant including, Festival Vendors, Exhibitors & Volunteers.

3. I hereby consent to receive medical treatment deemed necessary if I am (or any Dependent(s) are) injured or require medical attention while participating in the Festival. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation. I hereby release, forever discharge, and hold harmless the Released Parties from any claim based on such treatment or other medical services.

4. In consideration of my/our participation in the Festival, I hereby acknowledge and agree that I am a knowing, willful and willing participant, I agree that this Agreement may be introduced into evidence in any court or other proceeding by or against the Released Parties, and any of their lawyers or other agents, as well as by the venues and event hosts, sponsors or organizers, and that I will not object to this Agreement being entered into evidence in any action or matter or case arising from or related to the Festival and Festival activities, and that I acknowledge and agree that this is a full and complete Release of Liability, Waiver and Indemnity Agreement.

5. By my acceptance of the invitation and my voluntary presence at the Festival, and by entering the Festival’s ticketing website and reserving ticket(s) thereon, I acknowledge that I have carefully read this agreement and fully understand its contents. I am aware that this form is a waiver, a release of liability, and an indemnity agreement and a legally binding contract which I am entering into of my own free will.

6. I understand and agree that the Released Parties may NOT be held liable or responsible in any way to me, my Dependent(s) and/or my heirs, successors, assigns, or anyone claiming any interest through me or them, for any injury, death, property damage or other damage that may occur as a result of my participation on the Festival or as a result of the negligence of any participant or person, including, but not limited to, the Released Parties.

7. By attending the Festival, it is my intent to release, waive, hold harmless and indemnify all of the Released Parties from all liability, claims or causes of action connected with my (and my Dependents') participation in the Festival, and to personally assume all risk of injury, disability, death or property damage.

I UNDERSTAND THAT THE TERMS OF THIS AGREEMENT ARE CONTRACTUAL, AND I UNDERSTAND THAT I AM NOT PERMITTED TO PARTICIPATE IN THE FESTIVAL WITHOUT ENTERING INTO THIS AGREEMENT.
